Terms of Service

1. Provider and scope
These terms govern access to the JPT Trades membership (Discord community, live sessions, session archive, and curriculum), operated by Tim Ketterle (see Imprint). By purchasing or using the membership, you agree to these terms.
2. The Whop relationship
Membership access is sold and billed through Whop, Inc. Whop processes your payment, manages your subscription, and technically grants/revokes Discord access based on your billing status. Your contract for the membership itself is with JPT Trades (Tim Ketterle); Whop acts as the payment and access-control platform, not as the seller of the education/community service.
3. Contract formation
A contract is formed when you complete checkout through Whop and your payment method is confirmed. Access to the private Discord and member content begins immediately (or immediately after any free trial period ends), meaning digital service delivery starts right away rather than after a waiting period.
4. Subscription, billing, and cancellation
Membership is billed on a recurring monthly basis at the price shown at checkout, after any advertised free trial period. You can cancel at any time through Whop; cancellation stops future billing but does not refund the current billing period — you retain access until the end of the period you already paid for.
5. Right of withdrawal — needs legal confirmation
Under German/EU consumer law, purchases of digital content/services normally come with a 14-day right of withdrawal — but that right can be waived when the consumer explicitly requests immediate access and acknowledges losing the withdrawal right once the service has begun. Whether our current trial/checkout flow properly captures that acknowledgment, and what the correct withdrawal policy for this specific product looks like, has not yet been confirmed by a qualified professional. Do not rely on the absence of a stated withdrawal policy here as evidence that no consumer withdrawal obligation exists.
6. FernUSG — needs legal confirmation
JPT Trades includes structured trading curriculum content delivered alongside live coaching and community interaction. German law (the Fernunterrichtsschutzgesetz, FernUSG) can apply to certain remotely-delivered paid instruction and may require specific contractual protections or regulatory approval depending on exactly how the teaching is structured (live vs. recorded, degree of monitoring of learning progress, etc.). Whether FernUSG applies to JPT Trades has not been determined by a qualified professional and is explicitly flagged here rather than assumed either way.
7. Access and account sharing
Membership access is personal to the Whop account that purchased it. Sharing login credentials, Discord access, or session content with non-members is not permitted and may result in access being revoked without refund.
8. Intellectual property
All curriculum material, session recordings, and original content provided through the membership remain the property of JPT Trades. You may use it for your own personal education; you may not redistribute, resell, or publicly republish it.
9. Availability
Live sessions follow a published schedule but may be rescheduled, cancelled, or covered by a different coach due to illness, travel, or market holidays. Session archive access depends on our infrastructure providers (Bunny.net, Supabase, Vercel) remaining operational; we do not guarantee uninterrupted availability.
10. Community rules
Discord community members are expected to behave respectfully. We may remove members who harass others, share signals/copy-trading solicitations, impersonate coaches, or otherwise violate community standards, without refund for the remaining billing period in cases of serious misconduct.
11. Educational nature of the service
JPT Trades is education and community, not personalized financial advice, and not a signal or copy-trading service. See our full Risk & Education Disclosure for details. Trading involves real financial risk; no outcome is guaranteed.
12. Liability
To the extent permitted by law, JPT Trades is not liable for trading losses, missed sessions due to technical issues outside our control, or third-party service outages (Whop, Discord, Bunny.net, Vercel, Supabase). Nothing in these terms limits liability for intent or gross negligence, or other liability that cannot be excluded under applicable law.
13. Termination
You may cancel your membership at any time through Whop. We may suspend or terminate access for violation of these terms, non-payment, or community rule violations.
14. Governing law
These terms are governed by the laws of Germany, without prejudice to any mandatory consumer-protection provisions of your country of residence if you are a consumer within the EU.
